*** CALL TO ACTION ****
Protest on Thursday: âProtect Our Kidsâ
Aside from the tone-deaf placement of a lithium battery storage facility in the middle of a residential neighborhood, this site is surrounded by homes, schools, and local businesses.
Through civic engagement, weâve connected with neighbors near 57â77 Rust Street in Maspeth. After visiting the location, myself, I noticed a persistent humming noise coming from the facility. This constant sound is a nuisance and raises concerns about the long-term impact on residentsâ quality of life.
No family should have to live next to or across from an industrial energy storage facility that abuts their homes. The site is visually intrusive, and residents are understandably concerned about potential long-term effects related to noise, electromagnetic exposure, and vibration.
We are told that Nine Dot Energy has the legal right to use this property as approved. But what about the rights of homeowners, business owners, and students in the area?
⢠The school was not built next to an existing industrial plant.
⢠Homeowners did not purchase their properties knowing this was a possibility.
⢠Local businesses were established long before this facility was introduced.
The Right to Quiet Enjoyment
âQuiet enjoymentâ generally means the right to:
⢠Live in your home without unreasonable interference
⢠Expect privacy
⢠Be free from excessive noise or disruption
⢠Use your property legally without intrusion
For homeowners, protections may come through:
⢠Nuisance law
⢠Local zoning and noise ordinances
⢠Environmental and land use regulations
Local attorneys are now reviewing the situation to help protect our community. We want to ensure that when decisions affect residentsâ health, safety, and quality of life, there is accountability and proper oversight.
This is about balance. Clean energy matters â but so do neighborhoods, families, and children. Community voices deserve to be heard.
